Here is the latest update on the roof repair situation:

Inspection Option:

M/I Homes has advised that their roofing subcontractor is Hugh MacDonald Construction in Thonotosassa. Some owners have already contacted them and they are coming to Westlake on Friday 11/9/18 to look at those homes.

If you would like your roof inspected by them, their phone number is 813/986-4968. They will provide you with details on any costs associated with the inspection and/or repairs.

If repairs are needed, it may be possible to work with the other owners in your building to have the inspections/work done at the same time. Please check with your insurance company for more information on coordinating repairs.

The Board understands that there is a lot of information moving through the Community about hazard insurance, what’s covered, what isn’t and who is responsible for repairs.

The documents were created and recorded by M/I Homes and the Board is required to follow these documents.

In an effort to help owners find the relevant information in the Association documents, we’re providing a link to the Declaration and some information about the various sections relating to these issues. The Board is not offering legal advice, just providing a starting point for Owners, their insurance companies and contractors.

Section 10. Maintenance by the Association (found on page 16) contains multiple subsections that could, if not taken in context to the complete section, potentially lead to different interpretations.

In Subsection 10.11 Home Maintenance refers to areas for which either the Association collects reserves for long term replacement (painting, roofs) or for ongoing maintenance (termite control and pressure washing.) This does not cover hazard repairs (see last paragraph of Subsection 10.11 and Subsubsections 14.2.1 and 14.2.2, below)

Section 10 starts with:

“The Association shall be responsible for the following to be performed at the Board’s discretion and on such intervals as the Board may decide in its sole and absolute discretion:”

and follows with the 4 Sub-subsections for each item listed above.

Subsection 10.11 finishes with

“Notwithstanding anything to the contrary herein, to the extent insurance coverage required by Section 14.2.1 of the Declaration covers repairs or replacements otherwise performed by the Association under this Section 10.11, or would have covered such repairs if the owner had procured such coverage, such repairs or replacements shall be governed by Section 14.2.2 herein, and the Association shall not perform repairs or replacements covered by Insurance or any other activities that would negate such coverage or impair the ability of such coverage.”

14.2.1 which is referred to in Subsection 10.11 above states that each homeowner is required to obtain and maintain adequate insurance and requires that you provide evidence of insurance to the Association.

NOTE: Please watch for a letter from Greenacre ( it may be sent with your 2019 coupon book) with instructions for sending a copy of your insurance information.

14.2.2 which is also referred to in Subsection 10.11 provides details about what’s required for repair.

The Declaration supersedes any other document including the Standards. You should read each Section in its entirety and take appropriate action on any roof repairs needed for your home.
