After much thought and consulting with residents with varied concerns about the parking situation and the Amendment passed by the Board on 6/26, the following was proposed at the 7/19 Board meeting. The proposal, while it will not please everyone and will never guarantee anyone a parking space on the common property, is a compromise that will provide a more equal opportunity for access to the marked Resident and Guest spaces. Some major points of the proposal:
It allows for Residents to park in Guest spaces at the pool during pool hours, as from observation guests are usually infrequent during the portion of the day when most people are using the pool and the pool is only used by a few in the early evenings when guests are more frequent.
It eliminates the need for Guest passes unless a Guest is staying overnight.
It allows for parking on Fox Sparrow for the bus stop, just not where it endangers someone trying to turn onto or off Sheldon Road.
It offers more equitable sharing of the limited Resident spaces (15 when construction is complete) among 220 homes by tightening the number of nights in a calendar month that a Residence can utilize a Resident space. As we all pay for the Resident spaces and share equally in common space, the size of one’s garage or how many cars one has should not enter into the equation. Currently we have people storing cars in those spaces, which does not give their neighbors a fair opportunity to use the spots.
It frees up Guest spaces that are currently being used by residents storing cars.
It also requires ALL vehicles utilized in Westlake by Residents to be registered, which allows those who using a Resident space or parking at the pool during the day to use whichever of their cars they choose and also makes it easier to spot those in violation.

This document is an amendment to the Book of Community Standards for the Townhomes of Westlake and supersedes any previous amendments to such and the previous Parking and Permit Guidelines issued in January 2018, the letter on parking issued by Rizzetta on February 28, 2018 and the Amendment approved at the June 26, 2018 Board meeting.
The common elements of The Townhomes at Westlake include all parking spaces, sidewalks and roads, including Fox Sparrow all the way to Sheldon Road. Residents control their driveways from the garage to the edge of the sidewalk closest to their garage (or 17 feet, whichever is longer). These common elements are under the control of the HOA and all parking rules will be strictly enforced for resident and pet safety and to allow more equitable access for all residents and their guests.
Parking rules will be enforced 24 hours per day.
Beginning DATE TBD, 2018 Vehicles parked in violation of community parking rules are subject to towing as allowed by the Declarations, Section 12.4.4. A violation notice will first be placed on the vehicle. If the vehicle remains in violation for a period of 24 hours after the notice is placed on the vehicle or if the vehicle was cited for such violation within the preceding 14 day period, the vehicle may be towed. In addition, if the vehicle’s owner is a Resident, the Resident will also be fined $100, in addition to paying all applicable towing and storage charges. Other than occupied vehicles, no additional warnings will be given prior to issuing fines. Occupied vehicles cannot be towed but will be subject to fines. Occupied vehicles will be told to move before any violation is given. Failure to move the vehicle as instructed will result in a violation and a fine.
No vehicles, whether vacant or occupied, are to be parked on any street, except for loading/unloading. To facilitate students catching the school buses, Parking on Fox Sparrow from the gate to Sheldon is allowed, except for the last 150 feet to the intersection at Sheldon, which is a No Parking zone. Cars parked on Fox Sparrow outside the gate shall only park on the south side of the road traveling toward Sheldon. No cars are to be parked on the north side of the road traveling toward the gate from Sheldon.
No vehicles, whether vacant or occupied, are to be parked on flat concrete curbs next to pavement, sidewalks, drainage areas between the sidewalks and pavement, or grass (grass includes the entire length and both sides of Fox Sparrow from the Community to Sheldon).
Vehicles parked in driveways may not block the sidewalk. The 2 units with driveways shorter than 17 feet may have a vehicle extend up to 17 feet from their garage door.
Parking violations may be issued by the Association’s Directors, Management Company, the Association’s towing company or anyone else the Board may assign. Violations will be photographed and logged with a notice of violation placed on the vehicle.
Delivery service providers making quick stops, service providers with vehicles that are over-sized (cannot fit on a driveway AND are required to be parked near the home to provide service (pest control, carpet cleaning, etc.) and, until the completion of the last building, vehicles belonging to M/I Homes or their contractors will be exempt. It is the resident’s responsibility to insure the contractor’s vehicle is not on the the flat concrete curb next to the pavement, on a sidewalk, on grass, in the drainage areas between sidewalks and pavement or blocking access to or egress from any driveway or parking space.
Resident vehicles are required to have a valid parking sticker placed in their vehicle and readable from outside of the vehicle. Homeowners that do not live here full time, including but not limited to college students home for breaks, are considered Residents, not Guests, and will be issued Resident stickers for their vehicles.
Residents must register ALL vehicles residing within the Townhomes of Westlake with the Association and complete the Resident & Guest Parking Pass Request form and deliver it to the Association’s Management Company along with proof of valid registration and a valid driver’s license. Lessees must also present a copy of the active lease. Community Manager or their staff will validate and accept the completed Resident & Guest Parking Pass Request form and attach the Vehicle Identification Sticker to each registered vehicle. A Residence will be issued one active Guest pass for the purpose of guests staying overnight, which cannot be used for any Resident vehicle. When a new lease from a new lessee is presented to the Management Company or a new owner requests stickers and passes, all previous stickers and passes associated with that unit will be voided. Within 30 days after moving into the community, new residents must register all vehicles residing in Townhomes of Westlake. Failure to register any vehicle will result in a $100 fine. Residents already living here are hereby given 30 days to register all vehicles, and failure to do so will result in a $100 fine. It is the Resident’s responsibility to comply with all Florida vehicle laws, including having all vehicles properly registered and insured.
Within 7 days after acquiring a vehicle, a resident must contact the management company to have a sticker placed on the newly acquired vehicle and, if this replaces a vehicle, have the sticker on any sold/traded vehicle voided.
Parking spaces marked Resident are on a first come, first served basis for use by Residents of Westlake and only for vehicles displaying active, Resident parking permits. Residents must only park in Resident parking spaces, except they may park in available Guest spaces on the north side of the pool during normal pool hours from 7AM until dusk when using the pool or in the cabana.
A Residence may only utilize one Resident parking space at a time. If a Residence utilizes more than one Resident space at the same time, these vehicles will each receive a violation. Residents may only park in marked Resident parking spaces for a total of 2 nights in a calendar month per Residence in order to promote fair access for all 220 homes.
Guests must park in marked Guest parking spaces, which are on a first-come, first-served basis. Overnight guests parked in Guest spaces between 11PM-7AM must display an active Guest pass with Guest Pass Number (or Expiration Date for a Temporary Extended Pass) readable from outside the front of the vehicle, and may park in that space for a maximum of 2 nights without a Temporary Extended Guest pass.
Any vehicle parked in a Resident or Guest space between the hours of 11PM and 7AM without a valid sticker or pass may be issued a violation notice and after 24 hours may be towed without further notice if it is seen parked on the street or in ANY Resident or Guest space (anywhere on property) without an active Resident sticker or valid Guest pass. If such vehicle is owned by a Resident, a fine may also apply.
Any Temporary Extended Guest passes issued will only be valid for a maximum of 14 days. Temporary extended passes and renewals may be obtained from the Management Company office. However, after 3 renewals or 56 total days, the Guest vehicle will be considered to be a Resident vehicle and will be subject to all applicable rules and fines as a Resident vehicle.
Vehicles attempting to use voided, copied, fake or altered stickers or passes will be fined and/or towed. Voided stickers are those of former residents or issued to cars that have been sold, traded, donated or similarly disposed of.
If you anticipate having multiple guest vehicles for an event, it is your responsibility to make arrangements for parking.
The space marked “Mail” may be used by Residents for up to 5 minutes at a time for access to the mailboxes during times of the day when the mail person is not likely to arrive.
Since these rules are not required to be posted throughout the property, Residents are responsible for informing their guests, including contractors, service providers and delivery vehicles, of this parking policy.
