After much consideration and input from residents, the Board approved updated parking rules at the June 26th 2018 meeting. These changes will take effect beginning July 1, 2018.
The amendment is included in its entirety below but here are a few of the main changes:
- Parking rules are enforced 24/7
- Parking violations will now incur a fine, in addition to towing.
- Vehicles will not be towed without an initial 24 hour warning. Only 1 warning will be given so a vehicle in violation the next day, it may be towed without additional warnings.
- There is a limit to how many consecutive days a vehicle may be parked.

This document is an amendment to the Book of Community Standards for the Townhomes of Westlake and supersedes any previous amendments to such and the previous Parking and Permit Guidelines issued in January 2018 and the letter on parking issued by Rizzetta on February 28, 2018.
The common elements of The Townhomes at Westlake include all parking spaces, sidewalks and roads, including Fox Sparrow all the way to Sheldon Road. Residents control their driveways from the garage to the edge of the sidewalk closest to their garage (or 17 feet, whichever is longer)
These common elements are under the control of the HOA and all parking rules will be strictly enforced 24 hours per day for resident and pet safety and to allow equal access to all residents.
The Association previously changed the parking rules to allow limited parking for residents in some parking spaces. After many months, the Association has noted that a few residents are using these spaces for full-time storage of vehicles which is a violation of both the spirit and the letter of the rules. Other abuses of the parking rules have required these changes to insure that the community remains safe and that the parking spaces are made available on an equal basis.
This notice is being provided to all Association Members and every effort is being made to inform all non-Member Residents (Lessees), however, any Member who leases their unit must inform their current and future Lessees of these updated parking rules.
Some residents prefer to use their garage for storage, which is their right. However, no further accommodations will be made for additional parking spaces.
Beginning July 1, 2018 Vehicles parked in violation of community parking rules are subject to towing as allowed by the Declarations, AND, if the vehicle’s owner is a Resident, the resident will also be fined $100 for a parking violation, in addition to paying all applicable towing and storage charges. Other than occupied vehicles, no additional warnings will be given prior to issuing fines.
Parking violations may be issued by the Association’s Parking Enforcement Committee members, Directors, Management, or the Association’s towing company. Violations will be photographed and logged with a notice of violation placed on the vehicle.
Parked vehicles that are occupied (“Standing”) cannot be towed but will be subject to fines. This includes occupied vehicles parked on Fox Sparrow and vehicles “standing” on the sidewalk or in the street. Occupied vehicles will be told to move before any violation is given. Failure to move the vehicle as instructed will result in a violation and a fine.
Since these rules are not required to be posted throughout the property, Residents are responsible for informing their guests of this parking policy. That includes contractors, service providers, and others.
Delivery service providers making quick stops, service providers with vehicles that are over-sized (cannot fit on a driveway AND are required to be parked near the home to provide service (pest control, carpet cleaning, etc.) and, until the completion of the last building, vehicles belonging to M/I Homes or their contractors will be exempt. It is the resident’s responsibility to insure contractors do not park or “stand” on a sidewalk or in the drainage areas between sidewalks and pavement or block access to or egress from any driveway or parking space.
Rules:
Residents will be issued stickers based upon the number of spaces associated with their lot. One car garage units will be allowed two active stickers. Two car garage units are allowed four active stickers.
Residents must register their vehicles with the Association and complete the Resident & Guest Parking Pass Request form and deliver it along with the vehicle to the Association’s Management Company along with proof of valid registration and a valid driver’s license. Lessees must present a copy of the active lease. When a new lease from a new lessee is presented to the Management Company, all previous stickers associated with that unit will be voided.
Community Manager or their staff will validate and accept the completed Resident & Guest Parking Pass Request form and attach the Vehicle Identification Sticker to each registered vehicle.
Resident vehicles are required to have a valid parking sticker placed in their vehicle and visible from outside of the vehicle. Homeowners that do not live here full time, including but not limited to college students home for breaks, are considered Residents, not Guests, and will be issued Resident stickers for their vehicles, up to the limit assigned per unit.
Within 7 days after acquiring a vehicle, a resident must contact the management company to have a sticker placed on the newly acquired vehicle and, if this replaces a vehicle, have the sticker on any sold/traded vehicle voided.
No parking or standing vehicles on streets, sidewalks, drainage areas between the sidewalks and pavement, or grass (this also includes the entire length of Fox Sparrow from the Community to Sheldon)
Vehicles parked in driveways may not block the sidewalk. Those units with driveways shorter than 17 feet may have a vehicle extend up to 17 feet from their garage door.
Parking spaces marked “Resident” are on a first come, first serve basis for use by Residents of Westlake and only with a vehicle displaying an active, resident parking permit.
A Residence may only utilize one Resident parking space at a time. If a resident parks more than one vehicle in multiple spaces marked Resident at the same time, these vehicles will all receive a violation.
Only visitors to the West Lake community are permitted to park in a “Guest” space and visitor’s vehicles must display an active Guest pass.
Residents will be issued one active guest pass, which cannot be used for any Resident vehicle.
Any temporary guest passes issued will only be valid for 14 days. Temporary passes and renewals may be obtained from the Management Company office. However, after 3 renewals or 56 days, the Guest vehicle will be considered to be a Resident vehicle. There will be no grandfathering of previously issued temporary passes that were issued for longer than 14 days.
Vehicles attempting to use inactive stickers or passes, copies/faked passes or stickers will be fined and/or towed. Inactive stickers are those of former residents or issued to cars that have been sold, traded, donated or similarly disposed of.
It is the Resident’s responsibility to comply with all Florida vehicle laws, including having all vehicles properly registered and insured.
Residents using parking spaces may only park in marked Resident parking spaces, and may only park there for a maximum of 48 hours.
Guests must park in marked Guest parking spaces, must display an active guest pass with Guest Pass Number visible from outside the vehicle, and may park in that space for a maximum of 48 hours.
A Resident vehicle parked in ANY combination of resident spaces for 7 consecutive days (this includes moving to another resident space at or before the 48 hour limit) will be considered a storage vehicle and will be fined and towed.
A Guest vehicle parked in ANY combination of guest spaces for 10 consecutive days (this includes moving to another guest space at or before the 48 hour limit) will be considered a storage vehicle and will be towed.
Any vehicle parked in a Resident or Guest space or on the street (anywhere on community property) without a valid sticker or pass will be tagged and, after 24 hours, will be towed without further notice if it is seen parked on the street or in ANY Resident or Guest space (anywhere on property) without an active sticker or valid pass. If such vehicle is owned by a resident, a fine will also apply.
If you anticipate having multiple guest vehicles for an event, it is your responsibility to make arrangements for parking.
The space marked “Mail” may be used by Residents for access to the mailboxes during times of the day when the mail person is not likely to arrive, but has a 5 minute time limit per vehicle.
